These Terms of Service ("Terms") govern your access to and use of Performify, including performify.fit, app.performify.fit, and related services (the "Service"), operated by Performify LLC ("Performify," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is currently offered as a beta. This means it is still in active development and is provided on an early-access basis. During the beta:
You understand that the beta is provided so that we can test and improve the product, and that it should not be relied upon as a finished, production-grade service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised.

You retain ownership of the content you create or upload through the Service, such as training programs and athlete information ("Your Content"). You grant us a limited license to host, store, and process Your Content solely to provide and improve the Service. You are responsible for ensuring you have the right to submit Your Content and that it does not violate the rights of others.
The Service, including its software, design, features, and underlying technology, is owned by Performify and protected by intellectual property laws. These Terms do not grant you any right to our trademarks, logos, or proprietary technology except as needed to use the Service as intended.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. This is especially true during the beta period.
Performify is a coaching and programming tool. It does not provide medical advice, diagnosis, or treatment. Suggestions generated through the Service are informational and are always subject to the judgment of a qualified coach or the individual user. Consult a qualified professional before beginning or changing any training or health program.
To the fullest extent permitted by law, Performify and its owners and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the amount you paid us, if any, in the twelve months before the claim.
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and request account deletion at any time. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any disputes will be subject to the jurisdiction of the courts located in Colorado, unless otherwise required by applicable law.
We may update these Terms from time to time. When we do, we will revise the "last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
