Consumer health data privacy policy.
Effective October 19, 2026. This policy explains how Performify LLC (“Performify,” “we,” “us”) collects, uses, and shares consumer health data, as the Washington My Health My Data Act and Nevada law define it. It applies to consumers in Washington and Nevada and to anyone else whose consumer health data we process. Our general Privacy Notice is at performify.fit/privacy.html.
Consumer health data we collect
Readiness, soreness, sleep, and energy ratings; pain level and pain location; injury notes; and training data that may show your physical condition, such as workout performance and changes made because of pain or injury.
Why we collect and use it
To provide the Services you or your coach requested: to show your check-ins to you and your coach, to suggest training changes, to alert your coach when you report pain, to keep the Services secure, and to comply with law. We do not use consumer health data for advertising, and we do not sell it.
Sources
You, when you complete check-ins and log training. Your coach, when your coach records notes about your training.
Consumer health data we share
Your check-ins and training data are visible to the coach or team you join. We do not share consumer health data with any other third party, except service providers that process it for us under contract: Amazon Web Services (hosting, storage, and artificial intelligence processing through Amazon Bedrock) and Functional Software, Inc. (Sentry, error monitoring with personal information removed). We do not have affiliates that receive consumer health data.
Your rights
You can: (a) confirm whether we collect, share, or sell your consumer health data, and get a copy of it, including a list of the third parties and affiliates we shared it with and their contact information; (b) withdraw your consent to our collection and sharing of your consumer health data; and (c) have us delete your consumer health data. We will respond within 45 days. We may extend that by 45 more days when reasonably necessary, and we will tell you if we do.
How to make a request
Email main@performify.fit with the subject “Consumer Health Data Request.” We will verify your identity before we act on the request. A parent or guardian can make a request for a minor.
Appeals
If we deny your request, you can appeal by replying to our decision with the subject “Appeal.” We will answer the appeal within 45 days and explain our reasons. If you are not satisfied, you can contact the Washington State Attorney General at www.atg.wa.gov/file-complaint or the Nevada Attorney General at ag.nv.gov.
Changes
We will post any change to this policy on this page and update the effective date. If a change is material, we will ask for your consent again before we use your consumer health data in the new way.
